The parking lot operator shall only be liable for damage to a motor vehicle if such damage was caused by the parking lot operator or its employees intentionally or through gross negligence. This also applies to the re-parking of the motor vehicle, which is carried out by employees of the parking operator at the express request of the user.

3.2 Furthermore, the parking lot operator shall not be liable for damages caused directly or indirectly by force majeure to a parked motor vehicle.

3.3 The User undertakes to properly secure and lock the parked motor vehicle

Likewise, the parking of vehicles in violation of traffic regulations is prohibited.

5.2 In the event that a vehicle is parked in the parking lot contrary to the provisions of these parking regulations - in particular if towing would be justified according to the StVO - or if the permitted parking period is exceeded, the parking lot operator is entitled to take legal action against the registration owner.   • distributing advertising material without the prior written consent of the Parking Operator;
  • obstructing snow removal or gritting by parked vehicles.

6.3 The staff of the parking lot operator may issue additional orders at any time. These orders must be obeyed in any case.

7 Parking without a parking ticket and procedure in case of infringement

7.1 Parking a vehicle without a valid and lawfully obtained parking ticket constitutes a violation of possession.

7.2 In such a case, the parking operator is entitled to remove the vehicle or have it towed away for a fee. Furthermore, the parking lot operator or a third party commissioned by it reserves the right to charge a penalty (processing fee for the documentation of the infringement of possession, investigation of the owner of the registration and other related administrative activities).

This also applies if the parked vehicle is parked contrary to the provisions of these parking regulations.

7.3 In the event that payment is not made in due time, the claim shall be made by a service provider commissioned by the Parking Operator to handle the matter and/or by a lawyer, and the registration owner shall additionally reimburse the costs incurred in this regard (in particular reminder, investigation and lawyer's fees) within 30 days.

7.4 In the event of violations of these parking regulations, the parking operator shall be entitled to proceed with civil law actions (action for disturbance of possession, action for damages and/or a request to submit a declaration to cease and desist).

8. picture recordings

8.1 The Parking Lot Operator uses an image surveillance system for parking lot management, including automation and acceleration of the service for vehicles for which a parking lot ticket has been booked, as the Controller, which is operated in accordance with the provisions of the GDPR. 8.2 Personal data including license plate numbers, which are collected and stored by the Controller in the context of the User's requested re-parking of his motor vehicle or parking without a parking ticket, shall be deleted immediately as soon as the purpose of the processing (the Controller's legitimate interest in documentation, investigation and legal enforcement, such as in particular civil lawsuits, as well as legal defense against claims for damages) has been fulfilled and no statutory retention period precludes premature deletion.

8.3 Further information on the person responsible and on data protection can be found in the data protection regulations (https://shop.oetscher.at/datenschutzbestimmungen).

9.1 For this User Agreement and all legal disputes arising from it or in connection with it, the application of (substantive) Austrian law is exclusively agreed - excluding those reference norms which would lead to the application of foreign law.

9.2 For consumers who are domiciled in Austria at the time of the conclusion of the contract, the statutory places of jurisdiction shall apply.
