Data Protection Rights
What data protection rights do you have as a data subject?
As a data subject, you have the following rights at any time:
- Access, rectification, erasure, or restriction of the processing of your stored data (after clear identification through a valid identity document).
- Objection to the processing and use of your data for direct marketing purposes.
- Data portability in accordance with the requirements of data protection law.
Right to Confirmation
As a data subject, you have the right to obtain confirmation from us (after clear identification through a valid identity document) as to whether personal data concerning you is being processed. You can contact us at any time at info@oetscher.at.
Right of Access
As a data subject, you have the right to obtain from us (after clear identification through a valid identity document) free information at any time about the personal data stored about you and to receive a copy of this information. You can contact us at any time at info@oetscher.at.
Your right of access includes the following information:
- The purposes of processing,
- The categories of personal data being processed,
- The recipients or categories of recipients to whom personal data have been or will be disclosed,
- If possible, the planned duration of storage, or if not possible, the criteria used to determine this duration,
- The existence of a right to rectification or erasure of your personal data, or to restrict processing by us as the controller, or to object to such processing,
- The existence of a right to lodge a complaint with the Austrian Data Protection Authority as the supervisory authority,
- If the personal data were not collected from you: any available information about the source of the data.
As part of the operation of our websites, we commission software service providers and agencies that may have access to your personal data in the course of their work. These are contractually obligated to comply with the applicable data protection regulations. You may request further information about the service providers we engage by contacting info@hochkar.com.
Furthermore, you have the right to know whether your personal data have been transferred to a third country or an international organization. If this is the case, you have the right to be informed about the appropriate safeguards related to the transfer.
Right to Rectification
As a data subject, you have the right to request the immediate rectification of inaccurate personal data concerning you (after clear identification through a valid identity document). You can contact us for this purpose at info@hochkar.com.
Right to Erasure (“Right to Be Forgotten”)
As a data subject, you have the right to request the immediate deletion of your personal data (after clear identification through a valid identity document) if one of the following reasons applies and the processing is not required:
- Your personal data are no longer necessary for the purposes for which they were collected or otherwise processed.
- You withdraw your consent on which the processing was based pursuant to Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR, and there is no other legal basis for processing.
- You object to the processing pursuant to Art. 21 (1) GDPR, and there are no overriding legitimate grounds for processing, or you object pursuant to Art. 21 (2) GDPR.
- Your personal data have been unlawfully processed.
- The deletion of your personal data is required to comply with a legal obligation under Union or Austrian law to which we are subject as the controller.

Right to Restrict Processing
As a data subject, you have the right to request the restriction of processing (after clear identification through a valid identity document) if one of the following applies:
- The accuracy of the personal data is contested by you for a period enabling us to verify its accuracy.
- The processing is unlawful, and you oppose the erasure of your personal data and instead request the restriction of its use.
- We no longer need your personal data for the purposes of processing, but you require it for the establishment, exercise, or defense of legal claims.
- You have objected to processing pursuant to Art. 21 (1) GDPR and verification is pending as to whether our legitimate grounds override yours.

Right to Data Portability
As a data subject, you have the right to receive the personal data concerning you, which you have provided to us as the controller, in a structured, commonly used, and machine-readable format. You also have the right to transmit those data to another controller without hindrance from us, provided that the processing is based on consent pursuant to Art. 6 (1) (a) or Art. 9 (2) (a) GDPR or on a contract pursuant to Art. 6 (1) (b) GDPR and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or under official authority vested in us.
In exercising your right to data portability under Art. 20 (1) GDPR, you also have the right to have your personal data transmitted directly from one controller to another, where technically feasible and where this does not adversely affect the rights and freedoms of others.

Right to Object
As a data subject, you have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on Art. 6 (1) (e) or (f) GDPR. You can contact us at any time at info@hochkar.com.
If we process your personal data for direct marketing purposes, you have the right to object at any time to such processing for marketing activities.
