Terms and Conditions of Hochkar & Ötscher Tourismus GmbH

1 Scope of Application

1.1 Hochkar & Ötscher Tourismus GmbH, 3345 Göstling/Ybbs, 46; location Weitental 51, 3295 Lackenhof; info@oetscher.at (hereinafter referred to as the "Operator") operates ski slopes, lifts, and cable cars, as well as a 3D archery course in the Lackenhof am Ötscher region.

1.2 These General Terms and Conditions (hereinafter "GTC") apply to all services related to the use of the Operator’s ski slopes, transportation via its lifts and cable cars, use of the Operator’s 3D archery course, use of the Operator’s parking areas, and the sale of tickets (hereinafter collectively "Services") between the Operator and persons using these Services (hereinafter "Customers").

2 Tickets and Ticket Purchase

2.1 To use the ski slopes and to access the lifts and cable cars operated by the Operator, a valid access authorization is required. The Operator offers various types of access passes with different validity periods (e.g., hourly tickets, day tickets, multi-day tickets, season tickets, single tickets, group tickets, dog tickets, etc.; collectively referred to as "Lift Tickets").

2.2 The use of the Operator’s parking area requires a valid parking permit (hereinafter "Parking Ticket"). Holders of valid Lift Tickets or Archery Course Tickets may use the Operator’s parking areas free of charge during the validity period and within the opening hours of the parking area.

2.3 The use of the 3D archery course is not included in the Lift Ticket. A separate ticket (hereinafter "Archery Course Ticket") must be purchased for use of the 3D archery course.

2.4 The term "Tickets" hereafter refers collectively to Lift Tickets, Archery Course Tickets, and Parking Tickets.

2.5 Customers holding a Lower Austria Card or a Wilde Wunder Card may use certain discounts (see the respective websites for details).

2.6 Customers can purchase tickets either at on-site ticket counters or online via the Operator’s webshop at shop.oetscher.at. During the validity period of a purchased Lift Ticket and within the official operating hours (see Section 4), customers may use the ski slopes, lifts, and cable cars of the Operator. An Archery Course Ticket grants access to the 3D archery course at Ötscher during its operating hours (see Section 4). A Parking Ticket entitles the customer to use the Operator’s parking area during its opening hours (see Section 4).

2.7 Personal (name-based) tickets are non-transferable.

2.8 If the customer purchases a ticket via the Operator’s webshop, the provisions of Section 7 of these GTC additionally apply.

2.9 The Operator reserves the right to temporarily suspend ticket sales in the event of imminent overload of lifts, cable cars, slopes, or the 3D archery course. Customers are not entitled to the purchase of a ticket.

2.10 Once a ticket has been purchased, it cannot be changed or extended.

2.11 When a Keycard is issued, a deposit of EUR 2.00 is required. Upon return of the Keycard, the Operator refunds this amount, provided the card is undamaged.

2.12 Customers are required to carry a valid Lift Ticket while using the Operator’s ski slopes, lifts, and cable cars and to present it upon request to lift or slope personnel.

2.13 Lift Tickets are automatically checked by electronic control systems at access points. Access to lifts and cable cars is not possible without a valid Lift Ticket.

2.14 The Operator’s lift and slope personnel are authorized to perform random ticket inspections. Upon request, customers must present their valid Lift Ticket.

2.15 During winter operations, Lift Tickets for pedestrians are valid only on designated chairlifts and only for transport without winter sports equipment.

2.16 Customers holding personal tickets may, in the event of loss, block their ticket at a ticket counter by presenting proof of purchase and identity. A replacement ticket for the remaining validity period will be issued upon payment of a handling fee of EUR 25.00.

2.17 A valid Parking Ticket is required to use the Operator’s parking area.

3 Use of Ski Slopes, Lifts, and Cable Cars

3.1 When using the Operator’s lifts and cable cars, customers must comply with the legally approved transport regulations posted at each lift or cable car entrance.

3.2 The FIS rules apply on all ski slopes. These can be viewed at alpinesicherheit.at/10-fis-regeln.

3.3 Customers must follow the safety instructions given by the Operator’s lift and slope personnel.

4 Use of the 3D Archery Course

4.1 When using the 3D archery course, customers must follow the archery course rules, which can be viewed at https://www.oetscher.at/3dbogenparcours-oetscher and are provided in printed form before entry.

4.2 Bows and arrows can be rented for a fee at the Weitental lift ticket office near the umbrella bar during lift operating hours (see Section 4).

4.3 Customers must follow the safety instructions of the Operator’s staff.

5 Opening and Operating Hours

5.1 The respective opening and operating hours of the ski slopes, lifts, cable cars, and 3D archery course can be found at summer operations and winter operations.

5.2 The ski slopes are closed daily from 4:30 p.m. to 8:30 a.m. during the winter season (“closed period”). During this time, there is a high risk of injury due to slope preparation, winch cables, snowmaking, and exposed hoses. Slopes may not be entered or used during this period. An exception applies on designated touring evenings (Tuesdays), when slopes are open until 9:00 p.m. after lift operations end.

5.3 Special rides outside of regular operating hours are only possible upon individual agreement with the Operator. Such rides are not included in the ticket price and are charged separately.

6 Limitations of Service Offerings

Due to circumstances beyond the Operator’s control (e.g., accidents, bad weather, avalanche danger, mudslides, pandemics), services may be restricted (e.g., closure of slopes, lifts, or sections) if necessary for legal compliance or the safety and health of persons.

7 Refund of Ticket Purchase Prices

7.1 If restrictions under Section 5 are unreasonable for the customer because they are not minor or objectively justified, the customer is entitled to a (partial) refund of the ticket price.

7.2 Customers with tickets valid for at least two days may receive a partial refund in cases of sports injuries preventing further use. The refund applies from the day after the last use. Customers must provide a medical certificate from a local doctor or hospital and proof of purchase (or order confirmation if bought online).

7.3 These provisions do not affect the statutory right of withdrawal under the Distance and Off-Premises Transactions Act (see Section 7.4).

8 Special Provisions for the Webshop

8.1 General

8.1.1 These provisions apply to all purchases made via the Operator’s webshop at shop.oetscher.at. They do not apply to purchases made at on-site ticket counters.

8.1.2 Tickets available via the webshop are sold exclusively by the Operator.

8.1.3 All prices are stated in euros, including all taxes and fees.

8.2 Ordering Process and Pricing

8.2.1 Before submitting a binding offer, customers may review information about available ticket types in the webshop.

8.2.2 The webshop user interface provides information about prices, main characteristics, and validity periods of the available ticket types.

8.2.3 During the winter season, ticket prices are determined daily through an automated pricing process, meaning prices may vary depending on the time of inquiry. Personal data or individual browsing behavior are not used for price personalization.

8.2.4 After selecting the desired ticket and validity period, customers must provide their personal details (name, address, date of birth).

8.3 Order Confirmation, Contract Conclusion, and Ticket Receipt

8.3.1 Information displayed in the webshop does not constitute a binding offer but an invitation for the customer to submit an offer based on the displayed information. A legally binding contract is concluded only upon acceptance by the Operator via order confirmation email.

8.3.2 After selecting a ticket and entering personal details, the customer is shown an order summary with the opportunity to review and correct information.

8.3.3 By clicking “Pay,” the customer confirms their entries and is redirected to the payment provider. Completing payment constitutes a legally binding offer. The Operator’s confirmation of receipt does not yet constitute acceptance. A legally binding contract is concluded only upon separate confirmation of acceptance by email.

8.4 Information on the Right of Withdrawal

8.4.1 Customers purchasing choice or season tickets via the webshop are entitled to a statutory right of withdrawal under §11 of the Distance and Off-Premises Transactions Act ("FAGG").

8.4.2 Such contracts can be withdrawn within fourteen days of conclusion without stating reasons.

8.4.3 To exercise this right, customers must notify Hochkar & Ötscher Tourismus GmbH, 3345 Göstling/Ybbs, 46, location: Weitental 51, 3295 Lackenhof, +43 5/0138-300, info@oetscher.at of their decision to withdraw. Customers may use the Sample Withdrawal Form, although its use is not mandatory. The withdrawal period is observed if notification is sent before expiry.

8.4.4 If a customer withdraws, the Operator shall refund all payments received, including delivery costs (except additional costs from alternative delivery methods), within fourteen days of receiving notice. Refunds will be made using the same payment method unless otherwise agreed, and no fees will be charged.

8.4.5 If the customer requested performance to begin during the withdrawal period, they must pay a reasonable amount proportionate to the services rendered before withdrawal notification.

Note: Single-ride, hourly, day, multi-day, parking, and archery course tickets constitute leisure services tied to a specific date or period (§18 para. 1 Z 10 FAGG). Therefore, no right of withdrawal applies to such tickets purchased via the webshop.

8.5 Alternative Dispute Resolution

The European Commission provides an online dispute resolution platform at http://ec.europa.eu/consumers/odr/. The Operator is not obliged to and does not voluntarily participate in consumer arbitration proceedings.

10 Final Provisions

10.1 The Operator does not submit to any out-of-court complaint or legal remedy procedures.

10.2 These GTC can be accessed, saved, and printed at any time at https://www.oetscher.at/agb-oetscher.

10.3 The contract language is German. Only the German version of these GTC is legally binding.

10.4 Current tariff regulations can be found at https://www.oetscher.at/sommertickets-preise-oetscher or https://www.oetscher.at/wintertickets-preise-oetscher and are also displayed at ticket counters. The prices displayed locally apply exclusively to tickets purchased on-site.

10.5 The Operator reserves the right to amend these GTC from time to time. Such amendments apply only to future ticket purchases. The version in effect at the time of ticket purchase applies. This also applies for the entire validity period of a ticket.
