Voucher Terms and Conditions
- Through the website of the operator Hochkar & Ötscher Tourismus GmbH, 3345 Göstling/Ybbs 46 info@oetscher.at (hereinafter referred to as "Operator"), individuals who wish to use the services offered by the Operator (hereinafter referred to as "Customers") can purchase vouchers.
- The service provider INCERT eTourismus GmbH & Co KG is used to process the purchase of vouchers. The contract is concluded between the Customer and the Operator.
- The vouchers can be used exclusively for the purchase of services in the Operator’s webshop. The value of the voucher is credited to the total invoice amount. If the value of the selected service(s) exceeds the value of the voucher, the difference can be paid using any other valid payment method. If the value of the voucher exceeds the value of the selected services, the remaining balance remains on the voucher.
- Vouchers are generally valid for 30 years, unless a shorter validity period has been agreed upon for objectively justified reasons.
- When purchasing services in the Operator’s webshop, the General Terms and Conditions of the Operator apply, which are also available on the respective website.
- The information provided in connection with the purchase of vouchers does not constitute a binding offer by the Operator but an invitation to the Customer to submit an offer based on the displayed information. A legally binding contract is only concluded upon acceptance of the offer.
- After selecting the desired voucher amount and entering personal data, the Customer will be shown an overview of their order. The Customer has the opportunity to review and, if necessary, correct their entries.
- By clicking the "Pay" button, the Customer confirms their entries and is redirected to the payment service provider. After completion of the payment process, a legally binding contract is concluded.
- After completion of the payment process, the voucher will be sent to the email address provided by the Customer as part of the contract confirmation. The vouchers can be redeemed in the Operator’s webshop during the payment process by entering the personalized voucher number.
- The Operator reserves the right to exclude certain services from being purchased with vouchers. Excluded services are clearly marked in the Operator’s webshop.
- Cash payment of vouchers or remaining balances is excluded. Lost or stolen vouchers cannot be replaced.
- The European Commission provides a platform for online dispute resolution, available at http://ec.europa.eu/consumers/odr/. The Operator is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not voluntarily participate.

- These General Terms and Conditions can be accessed, saved, and printed at any time under AGB (oetscher.at).
- The contract language is German. Only the German version of these General Terms and Conditions is legally binding.
- The Operator reserves the right to change these General Terms and Conditions from time to time. Such changes apply only to future voucher purchases. The version valid at the time of purchase applies. This also applies to the entire validity period of a voucher.
Information on the Right of Withdrawal
Right of Withdrawal
The Customer has the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which the Customer or a third party named by the Customer, who is not the carrier, takes possession of the goods.
To exercise the right of withdrawal, the Customer must inform the Operator, Hochkar & Ötscher Tourismus GmbH, 3345 Göstling/Ybbs, No. 46, info@oetscher.at, of their decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). The Customer may use the model withdrawal form available under Withdrawal Form, although this is not mandatory. To meet the withdrawal deadline, it is sufficient for the Customer to send the notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If the Customer withdraws from this contract, the Operator shall reimburse all payments received from the Customer, including delivery costs (except for any additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery offered by the Operator), without undue delay and no later than fourteen days from the day on which the notice of withdrawal was received by the Operator. For this repayment, the Operator will use the same means of payment used by the Customer for the original transaction, unless expressly agreed otherwise; under no circumstances will the Customer be charged fees for this repayment.
The Operator may withhold reimbursement until the goods have been returned or until the Customer has provided proof that they have sent the goods back, whichever is earlier.
The Customer must return or hand over the goods to the Operator without undue delay and in any event no later than fourteen days from the day on which they informed the Operator of the withdrawal. The deadline is met if the Customer sends the goods before the fourteen-day period has expired.
The Customer shall bear the direct cost of returning the goods.
The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
