General Terms and Conditions (GTC) for the SunnyCard

 

SunnyCard & SunnyCard PLUS

1. General Information and Scope of Services

Hinterstoder-Wurzeralm Bergbahnen AG acts as a representative for all cable car and lift companies participating in the SunnyCard and SunnyCard PLUS programs, which are listed at https://skisport.com/de/sunnycard.

The SunnyCard, i.e., the SunnyCard PLUS and the SunnyCard, can be purchased either online via the websites of participating areas or directly from the participating cable car and lift companies. In all cases, these Terms and Conditions apply.

The contractual partners of the customer for the purchase of the SunnyCard and SunnyCard PLUS are the respective participating cable car and lift companies.

The SunnyCard and SunnyCard PLUS entitle the customer to use the facilities and slopes operated by the participating cable car and lift companies within the respective scope, as well as (where organized by the participating companies) the local ski bus during operating hours in the winter season (excluding offers from external partners).

The SunnyCard PLUS additionally entitles holders to use the lift facilities of the participating areas during the summer season (excluding bike transport and external offers).

The cable car and lift companies operate their facilities and slopes independently and under their own responsibility.

2. Conclusion of Contract

2.1 Online Order

The customer’s online order requires the complete and correct entry of all mandatory fields in the booking form, as well as the explicit acceptance of these Terms and Conditions.

Incorrect information may result in the withdrawal of authorization and exclusion from transportation without replacement.

SunnyCard and SunnyCard PLUS can only be booked with a current photo. The customer is obligated to immediately report any changes to their contact details (name, address, email address).

After entering the required data and clicking the “order with payment obligation” button, a legally binding offer to conclude a purchase contract is made. Acceptance of this purchase offer remains expressly reserved.

The customer will receive an email confirming acceptance of the purchase offer within 10 days at the latest.

These regulations apply analogously to purchases made at a participating cable car or lift company or any other contractual partner. For consumers within the meaning of the Consumer Protection Act (KSchG), a right of withdrawal applies to online purchases (cancellation policy and form are linked).

2.2 Scope of Services

The services covered by the SunnyCard and SunnyCard PLUS can be used after receiving the respective data carrier within the validity period and after the start of operation of the cable car and lift facilities.

3. Costs / Payment

3.1 Prices

Sales are made at the current rates listed on https://skisport.com/de/sunnycard or in the price lists and tariff notices.

When purchasing (except in the webshop), a deposit fee (KeyCard deposit) will be charged.

Payment can be made by credit card (Visa, Mastercard, Amex, Diners Club) or in cash.

3.2 Replacement Cards

For a lost or damaged card, a replacement card can be issued for a handling fee of €25 (plus KeyCard deposit). Proof of blocking and an official photo ID are required.

If the card was already used on the day the loss was reported, the replacement card is valid only for subsequent days.

3.3 Cancellation Webshop

In the event of a withdrawal from a ticket purchase via the webshop, a cancellation fee may apply.

4. Shipping

For online orders, the SunnyCard will be shipped within five working days after acceptance of the order. Postal delivery usually takes at least three working days.

5. Reloading a Data Carrier

The customer is responsible for correctly entering the data carrier number. Incorrect entries will prevent activation.

The booked service can be used no earlier than 60 minutes after receiving the confirmation.

6. Use of Services

These Terms and Conditions and the transport conditions of the respective companies apply.

No right of withdrawal in the case of:

  • Bad weather
  • Avalanche risk
  • Operational interruptions
  • Illness of the customer
  • Overcrowded slopes
  • Official restrictions (e.g., pandemics)

No refund is granted if services are available but not used by the customer for personal reasons (e.g., missing vaccination certificate).

7. Liability

Liability is limited to intent and gross negligence.

No guarantee for:

  • Uninterrupted availability
  • Complete range of services at all times

Up-to-date information is available at ticket offices, panorama boards, and online.

8. Refunds for Injuries or Illness

In principle, there is no entitlement to a refund.

As a gesture of goodwill, a refund may be granted if a medical certificate is submitted by March 30 at the latest.

9. Misuse

The cards are non-transferable.

Misuse will result in revocation without replacement and the obligation to pay the cost of a day ticket plus a fine (at least €40).

10. Data Protection

Data is processed in accordance with the GDPR and the Austrian Data Protection Act. See the data protection statements of the participating companies.

11. Applicable Law and Jurisdiction

Austrian law applies.

Consumers: the competent court at the place of residence or habitual residence.

EU consumers: alternatively, the court at their own place of residence.

Entrepreneurs: the court at the registered office of the defendant company.
