1. Privacy Policy

Protecting your personal data is of particular importance to us. We therefore strictly comply with all legal provisions when collecting and processing your personal data, especially the EU General Data Protection Regulation (GDPR) and the Austrian Data Protection Act as amended by the Data Protection Amendment Act 2018. Below, we would like to explain the most important aspects and inform you about the scope and purpose of our data processing activities as well as your rights as a data subject:

2. Collection and Processing of Personal Data

We store information that you voluntarily provide to us, for example during registration or when you contact us. This includes, in particular, your salutation, first and last name, address, telephone number, gender, date of birth, and email address.

We use the personal data you provide solely to the extent necessary to fulfill the respective purpose (e.g. registration, membership management, reservation of tennis courts, handling of challenge/tournament competitions, responding to inquiries, or enabling access to certain information). The purpose of processing your data is in particular to provide the services you have requested, as well as to operate our website, which includes information, presentation, and the offering of goods and services. The following services are currently available:

2.1 Online reservation of the slopes and slope areas we operate

Furthermore, we point out that, for the purpose of fulfilling contractual obligations, the data you provide while using our platform (IP address, name, address, and other contact details) will be stored. After the purpose has been fulfilled, we delete the data unless we are legally required to retain it.

We also use your data to send you information about our facilities, court closures, and information from our sponsors in connection with our facilities or events. These direct marketing purposes are legally justified by our legitimate interest. You can object to this processing for direct marketing purposes at any time by sending an email to info@oetscher.at.

3. Storage Period

Personal data processed for the execution of a contract will be deleted after the contract has been fully completed, following the expiration of legal retention periods and/or warranty and limitation periods, or for the duration of any ongoing legal disputes.

Personal data processed for marketing and information purposes will be deleted when you withdraw your consent, or at the latest three years after the last contact.

4. Data Transfer

Your data will not be transmitted to third parties (except to the company responsible for hosting; see point 8) unless we are legally required to do so, you have given your consent, or the transfer is consistent with the purpose of data processing. Exceptions include:

  • When reloading playing credits, payment data is transferred to the bank or the company behind the selected payment service provider;
  • When using the cash register function, data is transferred to the company providing this function for processing;
  • When using access control, data is transferred to the company providing the access control system for processing.

All recipients are and will be obligated by us to comply with data protection regulations.

5. Registration

During registration, you explicitly agree that you have read this privacy policy. It is available to you at any time at oetscher.tennisplatz.info/datenschutz.

If, after registration, you actually make tennis court reservations or use other modules (e.g. challenges, tournaments), you allow us to conduct a personal analysis and public display of your reservations, etc., to provide an overview of your activities on our tennis court. This may also be necessary for billing purposes and capacity assessment. We may assign internal administrators (e.g. caretakers) responsible for court management; these individuals also have access to reservation data. However, we ensure that other players or third parties cannot view your reservations or other activities. The only exception is the display of your first and last name and profile picture in the reservation calendar and in challenge or tournament competitions.

For the processing of tournaments and challenges, it is necessary that your participation, contact details (only for other participants), time and location of the match, and its result (including your first and last name) are listed and visible to all visitors of the website.

If you post entries in the message area, you also agree that your entry will be published with your first and last name.

6. Statistics / Cookies

In principle, you can use our website without providing personal data. If individual services require different provisions, you will be informed separately.

To improve our web services, optimize usability, and for visitor statistics, we use cookies. Cookies are small text files placed on your computer when you visit our website and enable your browser to be recognized upon subsequent visits. Cookies store information (e.g. duration of website visit or input data), preventing you from having to re-enter information each time. They also allow us to recognize your preferences and tailor our services to your interests. We do not use any cookies that require explicit consent. You can disable the use of cookies completely via your browser settings. However, please note that this may limit the functionality of our website. Data stored in our cookies is not linked to your personal data (name, address, etc.).

For visitor statistics, we use the tracking tool Google Analytics. Specifically, the following Analytics cookies are used in the standard configuration and stored for 30 days: _ga and _gat. These cookies are set by Google Analytics and enable monitoring of website usage to improve the user experience. They collect anonymous data such as visitor numbers, referring websites, and visited pages.

Google Analytics is a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This service uses cookies (see above). The information generated by these cookies about your use of the website is generally transmitted to and stored on a Google server in the USA. If IP anonymization is activated on this website, your IP address will first be shortened by Google within the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA or another third country and shortened there.

On our behalf, Google uses this information to evaluate your use of the website, compile reports on website activity, and provide other services related to website and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data. You can prevent the storage of cookies required by Google Analytics by selecting the appropriate settings in your browser software; however, this may limit website functionality. You can also prevent Google from collecting and processing data generated by cookies and related to your website use (including your IP address) by downloading and installing the browser plugin available here: http://tools.google.com/dlpage/gaoptout?hl=en.

7. Social Plugins

Our website uses Facebook social media plugins, recognizable by the company logo. When you visit our pages, a direct connection is established between your browser and the platform’s server via the plugin. These companies thereby receive the information that your IP address has accessed our pages. If you do not wish the platform to associate your visit with your user account, please log out of your respective user accounts.

8. Security

We use technical and organizational security measures to protect your data against manipulation, loss, destruction, and unauthorized access. Our security measures are continuously improved in line with technological developments. All data is stored on servers operated with a high security standard and protected against unauthorized access and misuse.

Your orders and bookings, as well as your personal data, are always transmitted to us in encrypted form (encryption protocol: Secure Socket Layer 3.0, key exchange: RSA 2048 bits, encryption of user data: RC4 128 bit and Triple-DES 112/168 bit).

Data storage and security are handled by Internex GmbH, Alserbachstraße 30, A-1090 Vienna, and Hetzner Online AG, Industriestr. 25, D-91710 Gunzenhausen. Storage therefore takes place in Austria and Germany.

9. Your Rights

As a data subject, you have the following rights and legal remedies:

  • Right of Access: You have the right to obtain information about whether – and if so, which – personal data concerning you are being processed. To prevent disclosure to unauthorized persons, we may need to verify your identity.
  • Right to Rectification and Erasure: You may request the correction or completion of incorrect personal data and the deletion of your data. We will comply immediately unless legal obligations prevent us from doing so.
  • Right to Restrict Processing: You have the right to restrict the processing of your personal data.
  • Right to Data Portability: You may request the transfer of collected personal data to a third party.
  • Right to Object: If there are reasons arising from your particular situation, you may object to the processing of your personal data at any time.
