Use of Image Data
Events, functions, etc.
Images (photos/videos) are taken at various events, in particular at press conferences and other functions organised by Hochkar & Ötscher Tourismus GmbH, or at which persons give presentations or perform, who are active on our premises, on our behalf or with our support.
At invitations and events, it is pointed out in advance that photography will take place. In cases where the media privilege (§ 9 DSG) does not apply, the photographer is instructed to obtain consent when photographing small groups of people. When larger groups are photographed at events, the images serve to raise awareness of our organisation and to promote its public image; we publish these photos on the internet and, where applicable, in printed materials about our organisation (legitimate interest).
If you are photographed as part of a small group or as an individual, the photographer will ask for your consent before taking the picture and will request that you sign a corresponding consent form as proof of your agreement. If you do not agree, you will have the opportunity to step aside so as not to appear in the photo. In cases where the media privilege (§ 9 DSG) does not apply, you have the right to withdraw your consent at any time with effect for the future.
In the event of withdrawal, the images will be deleted where technically possible, and efforts will be made to ensure their removal from any other media. Printed brochures will not be destroyed following a withdrawal. Upon receipt of the withdrawal, the data will no longer be processed for the stated purpose. If costs arise from the withdrawal and any prohibition of further use (such as website amendments or destruction of printed materials), and there is no legitimate interest in such withdrawal, the affected person shall bear the costs of these changes.
There is a right to object within the scope of statutory provisions, provided the processing is based on legitimate interest. Since by attending such events you enter a public space in which our organisation has a legitimate interest in promoting the event, this expectation must also be taken into account when considering any objection.
The data will be deleted once the copyright protection period has expired or upon withdrawal of consent, if published on our own website. If these data are published on social media networks, they will be deleted only upon withdrawal of consent.
For participation in audio/image/video recordings and advertising campaigns by Niederösterreich Werbung GmbH, the following personal data of the participants are processed: photo/video, first name, surname, and address. We store these personal data for as long as is necessary for the utilisation of the audio/image/video recordings and advertising campaigns, or as long as required for the pursuit or defence of legal claims.
Information pursuant to § 24 DSG 2000 regarding “Photocompare”
It is hereby noted that, for access control purposes, a reference photo of the lift pass holder is taken the first time they pass through a turnstile equipped with a camera. This reference photo is compared by lift personnel with those photos taken upon each subsequent passage through a camera-equipped turnstile. The reference photo is deleted immediately after the validity of the lift pass expires; all other photos are deleted no later than 30 minutes after the respective passage through a turnstile. It is also pointed out that there is an option to purchase lift passes that are technically configured so that no photo is taken when passing through the turnstile; however, random manual checks by lift personnel must be expected in such cases.
